Certain third party data sources (“Climatiq Data Partners”) require Customers to accept data-specific license restrictions. This page serves as an index of the applicable flow-down terms and identifies the additional terms that apply to all access to, and use of, any data supplied by the indicated Climatiq Data Partners (“Partner Licensed Data”), and is incorporated by reference into, and forms part of, the agreement under which Customer accesses or uses Partner Licensed Data. In the event Customer accesses or uses Partner Licensed Data, Customer agrees to be bound by the applicable Partner Page(s) identified on this index page. 

1. GENERAL PARTNER TERMS
   
   1. Attribution: The original source of each data point, as provided by Climatiq and Climatiq’s partners, shall be given attribution in the Customer’s application or report, including any partner-specific attribution requirements communicated by Climatiq in writing (including via the applicable Partner Page). 
   2. Updates: Climatiq may update or amend (a) this index page listing the applicable terms for Climatiq Data Partners, and (b) any individual set of terms issued by a Climatiq Data Partner (each a “Partner Page”), from time to time:
      
      1. When an update is made to a Partner Page that applies to the Customer, Climatiq will notify the Customer of the change by email or via an in-product notification. Provided that, where the Customer is a SaaS Partner or Consulting Partner and the relevant Partner Licensed Data is accessed or used by the Customer’s End Customers, Climatiq may instead provide notice to the SaaS Partner or Consulting Partner (as applicable) for onward notification to its End Customers. 
      2. Unless an update is required to take immediate effect to ensure compliance with obligations owed to a Climatiq Data Partner, the updated Partner Page will take effect 14 days after notification. Continued access to or use of the relevant Partner Licensed Data after the effective date constitutes acceptance of the updated terms; if Customer does not agree, Customer must cease accessing and using the applicable Partner Licensed Data as of the effective date. 
      3. Notwithstanding the foregoing, Climatiq may designate that an updated Partner Page applies only to (i) new purchases, orders, statements of work, subscriptions or other contracting arrangements for the applicable Partner Licensed Data entered into on or after the effective date of such updated Partner Page, and/or (ii) renewals of existing arrangements occurring on or after such effective date; in such case, the prior version of the applicable Partner Page will continue to govern the Customer’s access to and use of the applicable Partner Licensed Data under arrangements entered into before the effective date, unless the parties otherwise agree in writing or the update is required to take immediate effect to ensure compliance with obligations owed to a Climatiq Data Partner.
   3. Order of Precedence: These Partner Pages apply in addition to the terms under which the Customer accesses or uses Partner Licensed Data. They apply only to Partner Licensed Data and do not affect any other products or services. If there is any conflict between a Partner Page and those terms in relation to Partner Licensed Data, the Partner Page will prevail solely with respect to that Climatiq Data Partner’s Partner Licensed Data.
   4. For the purposes of these terms:
      
      1. “Direct Customer” means a Customer who contracts with Climatiq to access Partner Licensed Data for its own internal use. For Direct Customers, the terms in Section 2 below apply.
      2. "End Customer" means a Customer who contracts with one of Climatiq’s SaaS Partners or Consulting Partners, to access Partner Licensed Data for its own internal use. For End Customers, the terms in Section 2 below apply. 
      3. "SaaS Partner" means a Customer who contracts with Climatiq to access Partner Licensed Data, and integrates Climatiq’s APIs, data, and/or tools into their software for use by their own End Customers. For SaaS Partners, the terms in Section 3 below apply.
      4. "Consulting Partner" means a Customer who contracts with Climatiq to  access Partner Licensed Data, and who uses Climatiq’s APIs, data, and/or tools to provide services to their own End Customers. For Consulting Partners, the terms in Section 4 below apply.  ‍
2. DATA TERMS FOR DIRECT CUSTOMERS AND END CUSTOMERS
   
   1. The following additional terms and conditions shall apply to Customer if Customer is defined as either a Direct Customer or as an End Customer in relation to its access to, and use of, data supplied by each of the below Climatiq Data Partners:
